1Introduction & Acceptance

These Terms and Conditions ("Terms") govern your use of the website and services provided by Amazing Fitness Gym ("we", "us", "our"), a fitness and wellness company located in the United Republic of Tanzania. Our business comprises gym and exercise services (approximately 80%), fitness apparel and clothing sales (approximately 10%), and nutritional food and supplements related to exercise (approximately 10%).

By accessing our website, registering for a membership, booking classes, or purchasing any products or services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

2Definitions

• "Member" — any individual who has registered for a gym membership with us.
• "Services" — gym access, fitness classes, personal training, workout plans, and related exercise programs.
• "Products" — fitness clothing, apparel, nutritional food items, and supplements sold through our platform.
• "User" — any person who visits our website or uses our Services or purchases our Products.
• "Platform" — our website and any associated mobile applications.

3Membership Terms

3.1 Eligibility

Membership is available to individuals aged 18 years and above. Minors (16–17) may join with written parental or guardian consent. You must provide accurate and complete information during registration.

3.2 Membership Categories & Fees

We offer various membership categories and subscription plans. Fees, durations, and included services are displayed at our facility and on our platform. All fees are quoted in Tanzanian Shillings (TZS) and are subject to change with prior notice.

3.3 Non-Transferable Membership

Memberships are personal and non-transferable. Sharing membership cards, access credentials, or biometric data with others is strictly prohibited and may result in immediate termination without refund.

3.4 Health Declaration

Members are required to complete a health declaration during onboarding, disclosing any medical conditions, injuries, or physical limitations. It is the member's responsibility to update this information if their health status changes. We reserve the right to require medical clearance before allowing participation in certain activities.

3.5 Code of Conduct

• Members must follow all gym rules and respect staff instructions at all times.
• Appropriate attire and footwear must be worn inside the gym facility.
• Harassment, discrimination, or abusive behavior toward staff or other members will not be tolerated.
• Equipment must be used responsibly and returned after use.
• Amazing Fitness Gym reserves the right to suspend or terminate membership for violations of these rules.

4Online Purchases — Clothing & Food

4.1 Product Information

We strive to ensure that product descriptions, images, and pricing are accurate. However, we do not warrant that product descriptions or other content is entirely error-free. Colors and appearance may vary slightly from what is displayed on screen.

4.2 Pricing & Payment

All prices are in Tanzanian Shillings (TZS) and include applicable taxes unless stated otherwise. We reserve the right to change prices without notice. Orders are only confirmed once payment has been successfully processed.

4.3 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. If we decline an order after payment has been made, a full refund will be issued.

5Payment Terms

• We accept payments through AzamPay and supported mobile money services, including M-Pesa, Tigo Pesa, Airtel Money, and Halopesa.
• Payment is processed through AzamPay as a third-party payment processor. Your payment information is handled securely by AzamPay in accordance with their own terms and security standards.
• For recurring membership subscriptions, billing will occur automatically on the renewal date until you cancel your subscription.
• A payment is considered complete only when confirmed by AzamPay and reflected in our system.
• By making a payment, you authorize us and AzamPay to process the transaction for the stated amount.

6Health & Safety Disclaimer

Participation in exercise and fitness activities carries inherent risks. Members and users acknowledge that:

• They use gym equipment and participate in activities at their own risk.
• They should consult a qualified physician before beginning any exercise program, especially if they have pre-existing medical conditions.
• Amazing Fitness Gym, its owners, staff, and trainers are not liable for any injury, loss, or damage sustained during or resulting from participation in our services.
• Members must immediately stop any activity that causes pain, dizziness, or discomfort and notify staff.

7Intellectual Property

All content on this platform, including logos, text, graphics, exercise programs, class designs, videos, and software, is the property of Amazing Fitness Gym and is protected by intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

8User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are liable for all activities conducted through your account.
• Notify us immediately of any unauthorized use of your account.
• We may suspend or terminate accounts that violate these Terms.

9Limitation of Liability

To the maximum extent permitted by law, Amazing Fitness Gym shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products. Our total liability for any claim shall not exceed the amount you have paid us in the preceding three (3) months.

10Indemnification

You agree to indemnify and hold harmless Amazing Fitness Gym, its directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

11Termination

We may terminate or suspend your membership and access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services ceases immediately. Prepaid membership fees are handled in accordance with our Refund Policy.

12Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Tanzania.

13Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
